Mediation~ Uncontested Divorce (with or without children)

Lion of Justice, LLC has extensive previous experience in assisting of drafting and complete facilitation of divorce packages and conducts mediations pertaining to the following:


 Uncontested Divorce

  • Petition for Dissolution of Marriage  (requests the court open a file for the divorce proceedings of a final decree of divorce);
  • Marital Settlement Agreement (defines, divides, and distributes the parties equitable interest in assets, debts in detail);
  • Parenting Plan (outlines child custody arrangements, child support, and visitation, including worksheets; and
  • Final Decree of Dissolution of Marriage (requests the court for a final order for dissolution of marriage adopting the marital settlement agreement and parenting plan (if the parties have children), as well as requests that a name change be granted, if necessary.

Default Judgment of Divorce

A default may arise from a case in which one party has failed to respond, or if his/her whereabouts are unknown.  At that time, the spouse may request a default dissolution of marriage, so as to obtain a final decree without the non-responsive spouses involvement.  We provide   

  • Affidavit for Failure to Plead (acknowledges that the Respondent was properly served and that they failed to respond to the Petition for Dissolution of Marriage)
  • Request for Default Judgment and Final Decree for Dissolution of Marriage (requests the court for a final decree and default judgment for divorce)
  • Certificate As To The State of Record (clerk of the district court confirms the filing date of the Petition and when and how the Respondent was properly served)
  • Default Judgment and Final Decree of Dissolution of Marriage (orders the final decree, including outlining the parties assets, debts, real property, and parenting plan (if the parties have children)

Wills

A will or testament outlines and expresses a testator wishes as to how their property is to be distributed at death, and names one or more persons (personal representatives), the executor, to manage the estate until its final distribution.  We provide a complete comprehensive package as follows:

  • Application for Probate and for Appointment of Personal Representative (requests that the court will appoint personal representative);
  • Order of Probate of Will & Appointment of Personal Representative (judge orders appointment of personal representative);
  • Acceptance of Appointment as Personal Representative
  • Notice of Appointment of Personal Representative (notice of appointment of personal representative is sent out and probate action is processed);
  • Notice to Known Creditors (creditors are notified that personal representative is probating estate and notice is sent to creditors);
  • Inventory (gather & list the assets of the estate);
  • Accounting (determination of the debts of the estate & pay the valid)
  • Verified Statement of Personal Representative
  • Includes professional attorney review of documents, one hour of correspondence making contact with parties, attorneys, courts, judges, and any other individual, if necessary


Living Will 

A living will is in effect while a person is alive and states and defines the persons medical treatment preferences if they should become incapacitated.  Additionally, it can state the person's desire to a medical care provider or caring physician to withhold or not withhold life sustaining medical treatment. 


Power of Attorney

A power of attorney allows a representative to act on behalf of another person regarding their private affairs, business, or some other legal matter.  The person authorizing the other to act is the principal, grantor, or "power".  We provide the following power of attorneys, according to your individual needs:

  • Durable Power of Attorney (allows a local trusted person(s) you name as your attorney-in-fact, or representative, who must be willing to watch over your business interests and investments, such as real property, tangible personal property, stocks and bonds, commodities and options, banks and other financial institutions, operation of entity or business, insurance and annuities, estates, trusts and other beneficial interests, claims and litigation, personal and family maintenance, benefits from governmental programs or civil or military service, retirement plans, and taxes.
  • General Power of Attorney (allows an agent to take on your financial affairs when a person is mentally competent and will not applicable if a person becomes incapacitated);
  • Limited Power of Attorney (allows a special or "limited" financial/monetary power to a trusted agent to act on your behalf regarding business or financial/monetary related activities, as long as the agent acts "in your best interest", or you become incapacitated;
  • Medical Power of Attorney (allows an individual to be known as your agent, to make your medical decisions on your behalf if you become incapacitated or if you are not in a functioning mental state;
  • Tax Power of Attorney (allows another person to handle your responsibility regarding filing of state taxes);
  • Minor Child Power of Attorney (allows a parent to choose another family relative to take care of a minor on their behalf regarding healthcare and education for a limited time); and
  • Motor Vehicle Power of Attorney (allows an owner of a vehicle to allow a representative to sell, register, or apply for title on their behalf).
